LGE Appellate Attorney Robert Eisenberg Obtains Another Great Result for Client
Lemons, Grundy & Eisenberg appellate attorney Robert (Bob) Eisenberg successfully argued to the Nevada Supreme Court that a lower court incorrectly awarded attorneys fees and costs to an opposing party after a mistrial was declared and while a motion was pending to disqualify the trial judge. In Debiparshad vs. Eighth Judicial District Court, 137 Nev., Advance Opinion 71, a unanimous opinion issued on December 2, 2021, Nevada’s highest court held that “once a party files a motion to disqualify a judge pursuant to the Nevada Code of Judicial Conduct, that judge can take no further action in the case until the motion to disqualify is resolved. Further, if the motion is granted and the judge is disqualified, any order entered by the judge after the motion to disqualify was filed is void.” A full copy of this Nevada Supreme Court opinion can be obtained here.
